Creator Agreement

1. Eligibility and verification

You must be at least 18 years old to apply. Before you receive posting access, you must complete identity verification: a government-issued photo ID, a selfie holding that ID, and the signed creator declarations. Every application is reviewed manually. We may decline any application at our discretion, and posting access is granted only after approval.

2. Your content and ownership

You keep full ownership of the content you upload. Nothing in this agreement transfers ownership of your content to us. You grant us a non-exclusive, worldwide, royalty-free licence to host, encode, display, distribute, and promote your content on the platform, including creating previews, thumbnails, and watermarked versions, for as long as the content remains published on the platform. This licence ends for any content that is removed, except for copies we must keep for legal record-keeping, security, and backup purposes.

3. Consent to public display and distribution

By uploading content, you expressly consent to that content, including your likeness and your stage name, being published, publicly displayed, distributed, and promoted on smokingfetishhub.com, and made available to members under the access model you choose (subscription access, individual purchase, or tips).

You confirm this consent in two ways: by accepting this agreement, and individually, as a signed declaration, during creator verification. The signed declaration is stored with your identity records as evidence of your consent.

4. Withdrawing consent and removing content

You may withdraw your consent for any of your content at any time by requesting its removal via creators@smokingfetishhub.com or by unpublishing it from your account. Content for which consent is withdrawn is removed from public view promptly, and in any case within seven (7) days of the request.

Any person depicted in content on the platform, whether or not they are the uploading creator, may also request removal through our DMCA & Content Removal page. Content reported as depicting a person who did not consent is removed immediately upon verification of the complaint.

5. Content review before publication

Every piece of content you upload is reviewed by our team before publication. Content is not made publicly available on the website until it has been approved. We review each upload to confirm that it is not illegal, that it complies with this agreement and the content standards below, and that the required documentation exists for every person depicted.

We may reject or remove any content that fails this review. If you believe a decision was made in error, you may appeal through the process described on our DMCA & Content Removal page.

6. Content standards

You agree that all content you upload will comply with the following, without exception:

• Every person depicted was at least 18 years of age at the time of production.
• Before uploading content featuring any other person, you have provided us with a valid government-issued photo ID and a signed release for that person.
• Every person depicted gave informed consent to the production of the content and to its distribution on this platform.
• You are the rights holder of the content and have the legal right to distribute it.
• No content will depict any minor, any non-consensual act, or any person who is unconscious, intoxicated to incapacity, or otherwise unable to give consent.
• All content complies with applicable law and with the standards of the card networks and payment processors that serve the platform.

7. Records and documentation

We collect, process, and retain your identity documents, your signed declarations, and the IDs and releases of persons depicted in your content, as required by 18 U.S.C. §2257 and applicable card network rules, for as long as the law requires. You agree to cooperate with any compliance audit conducted by us, our payment processors, or the card networks, including providing additional documentation for your content when requested.

8. Earnings and payouts

You receive 70% of every sale of your content. The platform retains the remaining 30% as its commission. You receive 100% of tips sent to you by members. Refunds and chargebacks attributable to your content may be deducted from your balance. The payout schedule, minimum payout amount, and available payout methods are communicated to you when your account is approved. You are responsible for any taxes on your earnings.

9. Term and termination

This agreement applies from the date your creator account is approved and remains in effect until ended. You may stop uploading and close your creator account at any time. We may suspend or terminate your account for violation of this agreement, the creator declarations, or the Terms of Service. Violations of the content standards in section 6 result in immediate account termination and forfeiture of pending payouts. On termination, your published content is removed from public view, and records are retained only as required by law.

10. Your responsibility

You confirm that every declaration you signed during verification is true and will remain true for every piece of content you upload. You are responsible for the content you upload and for any claims arising from it or from your breach of this agreement. The platform is provided on an as-is basis.

11. Changes to this agreement

We may update this agreement from time to time. If we do, we will notify you by email at the address on your creator account, and the version number and effective date above will change. Continuing to upload content after an update takes effect means you accept the updated agreement.

12. Governing law

This agreement is governed by the laws of the U.S. state in which Cosy King LLC is organised, without regard to conflict-of-law rules, except where the law of your country of residence gives you rights that cannot be waived by contract.
